Here are the terms and conditions ("Conditions") From Blue Denim Lodge B.V. ("Josephine & Co' or 'we"). These Terms and Conditions apply to all orders you place with Josephine & Co through our web shop at www.josephineco.com ("Website’). ‘YOU"Means you, the customer." By placing an order, you agree that these Terms apply to the between you and Josephine & Co agreement entered into.

These Terms set out your rights and obligations in connection with your order for products through the Website. Please read these Terms carefully before placing any orders on the Website. We recommend that you keep a copy of the Terms for future reference.

    2. CONDITIONS OF ADMISSION TO PURCHASE

    2.1 Before you can make a purchase on the Website, it is important that you provide your information - such as your name, e-mail address, delivery address and payment details - correctly and completely in accordance with the instructions. You are responsible for the correctness of the information you provide. Josephine & Co reserves the right to refuse your order if you provide incorrect information. Josephine & Co uses the information you provide only as indicated in the privacy policy.

    2.2 To place an order with Josephine & Co you must be a consumer (and not a retailer) and in possession of a valid credit or debit card issued by a bank acceptable to us. For customers under the age of 18, the consent of a parent or guardian is required.

    2.3 Products purchased by the consumer are for personal use or as a gift and may not be resold or used for commercial purposes or any other commercial advantage. In addition, Josephine & Co reserves the right to limit multiple quantities of an item to be shipped to a customer or postal address.

    3. PRODUCTS

    3.1 We strive to describe the article (s) on the Website as accurately as possible. However, due to different imaging and display technologies or other technical reasons, slight differences in color and other differences in the item (s) may occur. Josephine & Co cannot be held responsible for these differences.

    3.2 All products remain the property of Josephine & Co until all amounts due to us under any agreement have been paid in full, including payment of expenses and for earlier, later or partial deliveries. You may not sell, dispose of or encumber products until full ownership has passed to you.

    3.3 We would like to draw your attention to the washing and maintenance instructions on the labels of the products. We are not liable for damage resulting from improper handling of products, including handling contrary to the instructions.

    3.4 In case of limited edition or limited production, additional restrictions, such as a limit on the number of products per customer, may apply. These additional restrictions will be notified to you through the Website.

    3.5 All products displayed on the Website are valid while stocks last. This means that a product displayed on the Website may no longer be available for purchase, although we aim to display the available stock on the Website.

    4. ORDERS

    4.1 All orders are subject to our acceptance and availability, and items in your shopping cart are not reserved and may be purchased by other consumers.

    4.2 Once you have completed the payment page and received your order confirmation by email, you cannot and we cannot make any changes to your order. Therefore, make sure that everything is correct.

    4.3 If you have provided your email address to be notified when a specific product displayed on the Website arrives, we will attempt to notify you within 48 hours from the time the product is posted on the Website.

    5. PRICE INFORMATION

    5.1 Prices displayed on the Website are in euros and include VAT at the applicable rate. The euro price of a product displayed on the Website at the time the order is accepted will be used unless there is an obvious mistake.

    5.2 Local charges (such as import duties, sales tax) may apply depending on your region and local customs duties. These costs are for your own account.

    5.3 The prices displayed on the Website can be changed in response to currency and exchange rate fluctuations, discounts and other commercial factors. The price applicable to your order is the price in effect at the time your order is accepted. Prices may vary between our products in physical stores and on the Website.

    5.4 We aim to correctly display all prices on the Website, but errors may occur. If we discover an error in the price of any of the items ordered by you, we will notify you of the price change by email and give you the option of reconfirming your order at the correct price or canceling your order. If we are unable to contact you, your order will be canceled. If you have already paid for the goods, we will refund you the full amount as soon as possible. If products are recalled while in transit, we will process your refund once the products have been returned to us.

    6. ACCEPTANCE OF YOUR ORDER

    6.1. When you place an order through our Website, we will send you an order confirmation by email. This confirmation email is a confirmation that we have received your order, but is not a confirmation of acceptance of your order.

    6.2 All orders placed by you must be accepted by us. Unless you cancel your order, the acceptance of your order and the formation of the agreement are between you and Josephine & Co completed when we send you an email to confirm that the goods have been shipped. 

    6.3 We reserve the right not to accept your order, for example if we are unable to obtain a payment authorization, if shipping restrictions apply to a particular item or delivery address, if the item ordered is out of stock or not meets our quality assurance standards and has been withdrawn, or if you do not meet the eligibility requirements as set out in these Terms.

    6.4 We may also, in our sole discretion, refuse to process a transaction and therefore refuse to accept it for any reason or deny service to anyone at any time. We will not be liable to you or any third party for the withdrawal of any products from the Website, whether such products have been sold or not, or for the removal, verification, or modification of any materials or content on the Website, or because of the refusal to process a transaction or the cancellation or suspension of a transaction after processing has started.

    6.5 If we are unable to deliver in accordance with the terms set out in the confirmation, we will contact you and give you the opportunity to cancel the order. If we have already received payment, we will refund you the corresponding amount.

    7. PAYMENTS

    7.1 We accept various payment methods including iDeal, Visa, MasterCard, Bank Contact / Mister Cash, PayPal and Giropay, as well as any other methods as clearly indicated on the Website from time to time.

    7.2 If you pay by credit card, you will be asked to provide the card number, the validity period of the credit card and the CVC code. We use the MasterCard SecureCode and SSL encryption, which prevents unauthorized access to credit card information. We do not store the credit card information after the transaction is completed.     7.3 All credit / debit card holders are subject to validation checks and authorization from the card issuer. If your payment card issuer refuses to authorize payment for any reason, we will notify you immediately at checkout. In that case we cannot be held responsible for any delay or non-delivery.

    7.4 If we choose, or are required to do so under applicable law, to issue or make available an invoice, we reserve the right to issue or make available electronic invoices and you agree to this form of billing.

    7.5 Promotion codes are non-transferable and there is no possibility to exchange promotions for cash. In addition, promotional codes cannot be used in conjunction with other promotional codes or offers and must be redeemed on the date specified, if given.

    8. RIGHT OF WITHDRAWAL AND RETURN

    8.1 You have a right of withdrawal within 30 days without giving reasons. The withdrawal period expires after 30 days from the day following the day on which you (or someone you have designated, other than a carrier) received the last delivery of the relevant order. In the case of partial deliveries, this period starts as soon as you have received the last item of your order.

    8.2 We do not exchange products. To exchange a product, you must return your purchase for a refund and place a new order.

    8.3 To exercise your right of withdrawal, you must notify us in writing of the withdrawal of your order by e-mail to: info@josephineco.nl

    8.3 To exercise your right of return, you must use the return form and return label provided with the shipment. In case of return, the following steps must be taken:

    1. Check the box (s) of the item (s) you want to return. Also enter the reason for the return.
    2. Pack your item (s) in the box / bag in which you received this (these) or in another box / bag and enclose this return form with the shipment.
    3. Stick the return label on the box / bag.
    4. Take the shipment to the nearest drop-off point and keep the receipt.
    5. Once your return has been received at our warehouse, we will process your refund immediately. Please note that it can take up to a week to see the refund (depending on your original payment method).

    8.4 All goods must be unused and / or unworn. All original packaging with pricing information, labels and tags must be intact. There must be no tape on the item (s) or its packaging. All items must be returned in a box to protect their shape. Returns that do not comply with our policies will not be accepted and will be sent back to you.

    8.5 We will refund you in full, including the shipping costs you paid. If you return part of your order, we will only refund the cost of the returned item. We may deduct an amount from the refund for diminished value of delivered goods, if this diminution is the result of unnecessary handling by you (such as, without limitation, use and / or carrying of the goods).

    8.6 We will refund you without undue delay, but no later than:

    (i) 30 days after the day on which we receive back from you any goods delivered to you; or
    (ii) (if earlier) 30 days from the day on which you provide us with proof that the goods have been returned; or
    (iii) if no goods have been delivered: 30 days after the day on which we were informed of your withdrawal.

    8.7 We will refund you using the same payment methods you used for the original transaction, unless you have explicitly stated otherwise. In any case, you will not owe any fees as a result of the refund.

    8.8 If we have shipped goods to you and you have canceled your order, we may withhold a refund until we have received the goods back or you have provided proof that you have returned the goods, whichever occurs first. If we do not receive the goods back, we can have them collected from you and the costs will be borne by you.

    8.9 We will bear the reasonable costs for the return if you have followed our return instructions.

    9. DELIVERY

    9.1 We offer a range of delivery options from which you can choose the method that best suits your needs. Specific terms and conditions and different delivery charges may apply to the various delivery options. Please see full information about this in us shipping policy.

    9.2 We offer worldwide shipping via our partner PostNL. The exact shipping rates depend on the amount of your order and / or the country to which your order is shipped.

    9.3 All shipments are insured and have a tracking number with which the shipment can be tracked. This tracking number will be provided to you in the shipping confirmation email. It should be noted that this tracking information is hosted by the courier's website and is not monitored by us.

    10. DAMAGED OR DEFECTIVE ITEMS

    10.1 All items from Josephine & Co come with a one-year warranty against material defects and manufacturing defects. This warranty period may vary depending on the applicable law of the country to which the item is shipped. This warranty only covers manufacturing defects.

    10.2 If the problem is caused for reasons other than the quality of materials or the assembly process, the original product will be returned to you. We do not refund products:

    • obtained from a source other than the Website or a physical store of Josephine & Co;
    • that have been damaged by improper use or negligence (i.e. exposure to chemicals, caustic substances, open flames, heat, sharp objects, etc.); and / or
    • damaged by improper use or activities other than intended purpose.

    10.3 The life expectancy of a product depends on the individual user of the product, the conditions of use and the user's specific wear patterns. If our products are damaged through normal wear and tear or if their reasonable lifespan has been exceeded, they will not be replaced.

    10.4 If you think you can claim a guarantee for an online purchase, you can contact our customer service by email at: info@josephineco.nl. In this email, please provide the original order number, photos of the suspected shortcoming and a brief description of the claim. Our customer service department will decide whether the damage is the result of a manufacturing defect or a deviation from factory specifications. If our customer service determines that you have a claim, the item (s) will be refunded to you or replaced if possible (based on availability).

    11. USE OF THE WEBSITE

    11.1 At times, our Website may contain information containing typos, inaccuracies or omissions in relation to product descriptions, pricing information, offers, quotations, shipping costs or availability. We reserve the right to correct any errors, inaccuracies or omissions at any time without notice, to change or update information, or to cancel orders in the event of an obvious mistake.

    11.2 You agree that you are personally responsible for your use of this Website and for all your communications and activities on and in connection with this Website. If we determine that you have been or have been involved in prohibited activities, were disrespectful to other users, or otherwise violated the Terms, we may temporarily or permanently deny you access to this Website.

    15. LIABILITY

    15.1 Any liability and responsibility of Josephine & Co, its subsidiaries and their respective officers, directors, employees, shareholders or agents is excluded for any amount or loss or damage to you or any third party (including direct or indirect loss or damage, indemnities or consequential loss, loss of income or profit, loss of goodwill, data, agreements, or loss or damage that arises in any way from or in connection with business interruption, missed opportunities, loss of anticipated savings, waste of management or office time and regardless whether this arises from contract, tort (including negligence) or otherwise, even if already foreseeable) in connection with: (i) this Website, (ii) use, inability to use or the results of this Website , (iii) any websites linked to this Website and (iv) any data on this Website. Your sole and exclusive remedy in connection with the above or in connection with any dispute with Josephine & Co, its subsidiaries and their respective officers, directors, employees, shareholders or agents is to cease your use of the Website.

    15.2 Nothing in these Terms excludes or limits any person's liability for death or personal injury arising from your own negligence, nor any person's liability for fraudulent misrepresentation, nor any other liability that cannot be excluded. or limited by applicable law. Nothing in these Terms affects your statutory rights as a consumer such as your right of return and right to a free warranty for defective goods.

    15.3 If we fail to comply with these Terms, we are liable for any loss or damage that you suffer as a foreseeable result of our breach of the Terms.     17. APPLICABLE LAW AND JURISDICTION

    17.1 Only Dutch law is applicable to these Conditions and the agreement entered into by you and Josephine & Co, with the exclusion of the UN Convention on Contracts for the International Sale of Goods.

    17.2 The competent court in Amsterdam has the exclusive jurisdiction to hear and settle any disputes that could arise from these Terms and Conditions or the agreement entered into by you and Josephine & Co.

    18. CHANGES TO THIS INFORMATION

    18.1 Josephine & Co reserves the right, at its sole discretion, to change these Terms at any time without notice. Changes will be published on our Website, indicating the date of their last update. If you continue to visit the Website, you are automatically bound by the amended Terms and Conditions. We therefore advise you to check these Terms regularly.
